The Department for Public Prosecution Defense is an independent structural unit of the Prosecutor General’s Office of the Republic of Azerbaijan.
The main duties and functions of the Department: to provide protection of the public prosecution in court through the participation of the prosecutor as a public prosecutor in a criminal case or other materials related to criminal prosecution; ensure the participation of prosecutors in the courts of first, appeal and cassation instances, except in cases of special accusation; to ensure the protection of the public prosecution in the consideration of criminal cases and simplified pre-trial proceedings in the courts of first instance; to ensure the filing of appeals and cassation protests against sentences or other decisions of the courts in criminal cases or simplified pre-trial proceedings, as well as the participation of prosecutors in the appeal and cassation review of sentences and decisions of the courts; resolve issues related to the participation of the Prosecutor General in the Plenum of the Supreme Court of the Republic of Azerbaijan in cassation proceedings, on newly opened cases and on new cases on violation of rights and freedoms; to organize the participation of prosecutors in resolving doubts and misunderstandings during the execution of a sentence or other final court decision; to give opinions and proposals on special court decisions in relation to prosecutors and investigators of the prosecutor's office; to ensure the formation of a unified practice of defense of the state prosecution, etc.
